These Terms and Conditions (“Terms”) govern your access to and use of shop.car-parts.co.za (“the Website”), including the purchase of products, submission of part requests, creation of customer accounts and use of any related services provided by Car-Parts.co.za.
By using the Website or placing an order, you agree to these Terms.
Nothing in these Terms is intended to limit or exclude any rights that you may have under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), or any other applicable South African law.
If any provision of these Terms conflicts with a mandatory provision of applicable law, the applicable law will prevail.

References in these Terms to “Car-Parts.co.za”, “we”, “our” or “us” refer to the legal entity operating the Website.
2. Use of the Website
You may use the Website only for lawful purposes.
You agree not to:
- Use the Website for fraudulent or unlawful activities;
- Attempt to gain unauthorised access to the Website, accounts, servers or systems;
- Introduce viruses, malicious code or other harmful material;
- Interfere with the proper operation or security of the Website;
- Scrape, copy or automatically extract Website content without our permission where prohibited by law;
- Impersonate another person;
- Submit false vehicle, customer, payment or delivery information; or
- Use the Website in a manner that infringes another person’s rights.
We may restrict or suspend access where we reasonably believe the Website is being misused.
3. Customer Accounts
Certain features may require you to create an account.
You are responsible for:
- Providing accurate and current information;
- Keeping your login credentials confidential;
- Maintaining the security of your account; and
- Informing us promptly if you suspect unauthorised access.
You remain responsible for activity conducted through your account to the extent permitted by law.
We may suspend or close an account where there is evidence of fraud, abuse, unlawful activity or a material breach of these Terms.
4. Product Information
We take reasonable steps to ensure that product descriptions, photographs, specifications, part numbers and other information displayed on the Website are accurate.
However:
- Product photographs may be illustrative;
- Packaging may change;
- Manufacturer specifications may change;
- Minor differences in appearance may occur;
- The same vehicle model may use different parts depending on production date, engine, derivative, transmission, chassis number or other specifications; and
- Certain products may be supplied under superseded or replacement manufacturer part numbers.
Where a difference is material to the product’s purpose, compatibility or value, your statutory consumer rights remain unaffected.
5. Vehicle and Part Compatibility
Correct vehicle identification is particularly important when purchasing automotive parts.
We may request information such as:
- Vehicle make;
- Model;
- Model year;
- Engine type;
- Engine code;
- Derivative;
- Transmission;
- VIN or chassis number;
- OEM part number;
- Existing part photographs; or
- Other identifying information.
You must provide accurate information where you ask us to identify or recommend a compatible part.
If you order a product independently without requesting compatibility assistance, you are responsible for checking that the part is appropriate for your vehicle.
Where we expressly confirm that a part is compatible based on complete and accurate vehicle information supplied by you, that confirmation forms part of the transaction subject to applicable law.
We are not responsible for an incorrect match caused directly by materially inaccurate or incomplete vehicle information supplied to us.
Nothing in this section limits your statutory rights where goods do not comply with the CPA or where the error was caused by us.
6. Part Requests and Quotations
Submitting a “Request a Part” form, VIN, photograph or other enquiry does not itself constitute an order.
If we source a requested item, we may provide:
- A product recommendation;
- A quotation;
- A payment request; or
- A link through which the product may be ordered.
Unless expressly stated otherwise, a quotation does not guarantee availability until the order has been accepted and stock allocated.
Quotations may be subject to an expiry date.
7. Prices
Unless otherwise stated, prices displayed on the Website are in South African Rand (ZAR).
Prices will include VAT where Car-Parts.co.za is required to charge VAT.
Delivery costs and other applicable charges will be disclosed before completion of the transaction where required.
We will not require a consumer to pay more than the applicable displayed price contrary to the CPA.
Where a displayed price contains an inadvertent and obvious error, we may correct the error and take reasonable steps to notify affected customers, as permitted by applicable law.
8. Placing an Order
Products placed in your shopping cart are not reserved until your order has been successfully submitted and, where applicable, payment has been authorised.
Before submitting an electronic order, you will be given an opportunity to review the transaction and correct relevant errors.
After you place an order, we may send an automated acknowledgement.
An automated acknowledgement of receipt does not necessarily mean that stock has been allocated or that the order has been finally accepted.
An order will be regarded as accepted once we confirm acceptance, allocate the relevant product, dispatch the order or otherwise communicate that the order has been accepted.
9. Availability
All products are subject to availability.
Automotive parts inventories may change rapidly, particularly where stock is obtained from manufacturers, distributors, importers or third-party warehouses.
If an ordered product becomes unavailable, we may:
- Offer an equivalent or alternative product for your approval;
- Place the item on backorder with your agreement; or
- Cancel the unavailable item and refund the amount paid for it.
We will not substitute a materially different product without your agreement.
10. Payment
Available payment methods will be displayed during checkout.
Payments may be processed by independent payment service providers.
You warrant that you are authorised to use the payment method selected.
We may delay processing or dispatch where:
- Payment has not been received;
- Payment cannot be verified;
- The payment provider rejects or reverses the transaction; or
- We reasonably suspect fraud.
We do not intend to store complete payment-card information where payment details are processed directly by an authorised third-party payment provider.
11. Fraud Prevention
We reserve the right to perform reasonable verification procedures before accepting or dispatching an order.
We may request reasonable supporting information where a transaction appears unusual or potentially fraudulent.
An order may be cancelled where we reasonably determine that it is fraudulent, unlawful or unauthorised.
Any personal information collected for fraud-prevention purposes will be handled in accordance with our Privacy Policy and applicable law.
12. Delivery
We deliver orders using our own delivery arrangements or third-party courier and logistics providers.
Available delivery methods, charges and estimated delivery periods will be communicated on the Website, during checkout or when confirming the order.
Delivery estimates are estimates unless we expressly agree to a fixed delivery date.
Delays may occur because of circumstances including:
- Courier delays;
- Supplier delays;
- Severe weather;
- Road closures;
- Strikes;
- Public emergencies;
- Customs or import delays;
- Remote delivery locations; or
- Events outside our reasonable control.
Nothing in this section limits any right you may have under ECTA, the CPA or other applicable law regarding the timely performance of an electronic transaction.
13. Delivery Information
You are responsible for providing an accurate and accessible delivery address and valid contact details.
If a delivery cannot be completed because the address or other information you provided is materially incorrect, we may charge reasonable additional delivery costs where permitted by law.
You should inspect the parcel as soon as reasonably possible after delivery.
If a parcel appears damaged, tampered with or incomplete, please notify us promptly and retain:
- The packaging;
- Shipping label;
- Product;
- Photographs of the damage; and
- Any other evidence reasonably required to investigate the matter.
Failure to notify us immediately does not remove any statutory rights you may have.
14. Risk and Ownership
Risk in goods will pass in accordance with applicable law and the terms of the relevant transaction.
Ownership of products remains with Car-Parts.co.za until payment has been received in full, to the extent permitted by law.
Nothing in this section transfers delivery-related risk to a consumer earlier than permitted by applicable consumer law.
15. Online Cooling-Off Rights
Where section 44 of ECTA applies to an electronic transaction, a consumer may cancel a qualifying transaction for goods, without reason and without penalty, within seven days after receiving the goods.
Where this statutory cooling-off right applies:
- The consumer may be responsible only for the direct cost of returning the goods, as permitted by ECTA; and
- Any refund will be processed within the period prescribed by applicable law.
The ECTA cooling-off right does not apply to certain transactions specifically excluded by law.
These statutory exclusions may include, among other things, goods that:
- Are made to the consumer’s specifications;
- Are clearly personalised;
- By their nature cannot be returned; or
- Fall within another statutory exception.
A part is not automatically excluded from statutory return rights merely because it is an automotive, electrical or specially sourced component. Any exclusion will be applied only where permitted by law.
16. Change-of-Mind Returns
In addition to any rights required by law, Car-Parts.co.za may allow change-of-mind returns in accordance with any Returns and Refund Policy published on the Website.
For a non-defective change-of-mind return, we may reasonably require that the product:
- Is returned within the applicable return period;
- Has not been unnecessarily used or damaged;
- Includes the accessories and components originally supplied;
- Is accompanied by reasonable proof of purchase; and
- Is returned in appropriate packaging where reasonably possible.
Any deductions, return charges or limitations will apply only to the extent permitted by law.
Your rights relating to defective or non-compliant goods are separate from a voluntary change-of-mind return policy.
17. Special-Order Products
Some automotive components may need to be specially sourced or ordered from a manufacturer, importer or distributor specifically following a customer request.
We will identify material special-order conditions before the order is completed where reasonably practicable.
Special-order status does not automatically remove rights granted by the CPA or ECTA.
Where a statutory exception legitimately applies—for example, where goods have been made to your specifications or clearly personalised—the ordinary cooling-off right may not apply.
Where no statutory right to cancellation exists, reasonable cancellation costs may apply to a special order if disclosed and permitted by law.
18. Defective Goods and Statutory Warranty
Consumers have rights to goods of appropriate quality under the CPA.
Subject to the Act and its applicable provisions, goods supplied to a consumer are subject to an implied warranty of quality.
If goods fail to satisfy the applicable statutory standards within six months after delivery, the consumer may, where the CPA applies and subject to its requirements, return the goods without penalty and at the supplier’s risk and expense and direct that the goods be:
- Repaired;
- Replaced; or
- Refunded.
This statutory warranty is additional to any valid manufacturer or supplier warranty.
We may reasonably inspect a returned product to determine the nature and cause of an alleged defect.
A statutory defect claim may not apply where the problem was caused after delivery by circumstances such as:
- Incorrect installation;
- Misuse or abuse;
- Accident or collision damage;
- Unauthorised modification;
- Incorrect voltage or electrical connection;
- Use contrary to manufacturer instructions;
- Contamination;
- External mechanical damage; or
- Normal wear and tear where applicable.
The existence of one of these circumstances must be relevant to the claimed failure. We will not reject a statutory warranty claim merely because a product has been opened, fitted or tested where doing so would unlawfully limit a consumer’s rights.
19. Manufacturer Warranties
Certain products may carry a manufacturer, importer or distributor warranty extending beyond statutory rights.
Any additional warranty may have its own:
- Duration;
- Registration requirements;
- Maintenance requirements;
- Installation conditions; and
- Claim procedures.
Manufacturer warranties operate in addition to, and do not replace, statutory rights that cannot legally be excluded.
20. Installation and Fitment
Automotive components should be installed in accordance with the vehicle and component manufacturer’s requirements.
Where appropriate, we recommend installation by a suitably qualified automotive technician.
Certain components may require:
- Specialist tools;
- Calibration;
- Coding or programming;
- Adaptation;
- Correct torque specifications;
- System bleeding or priming;
- Diagnostic procedures; or
- Replacement of related components.
We are not responsible for damage caused by negligent or incorrect installation by the customer or an independent installer.
This provision does not exclude liability for a defective product, incorrect instructions supplied by us, an incorrect compatibility representation attributable to us, or any liability that cannot lawfully be excluded.
Unless expressly agreed in writing, the sale of a part does not include installation services.
21. Safety-Critical Components
Certain automotive parts can affect vehicle safety.
Examples may include components relating to:
- Braking;
- Steering;
- Suspension;
- Fuel systems;
- Airbags and restraint systems;
- Wheels;
- Electrical safety; and
- Engine management.
Customers must ensure that safety-critical parts are suitable for the relevant application and properly installed.
Do not operate a vehicle if a component has been installed incorrectly or if the vehicle is unsafe.
22. Used, Refurbished or Reconditioned Products
Where we sell a product as used, refurbished, remanufactured or reconditioned, that condition will be disclosed in the product description or before purchase.
Reasonable signs of prior use may be expected from products expressly sold as used.
Where specific defects, wear or limitations are disclosed before purchase and expressly accepted by the customer as permitted by law, those disclosed characteristics will be taken into account when determining whether the product complies with the agreed condition.
This provision does not permit us to conceal defects or exclude statutory rights unlawfully.
23. Incorrect Product Supplied
If we supply a product materially different from what you ordered, please contact us as soon as reasonably possible.
Where the error is ours, we will arrange an appropriate remedy in accordance with applicable law, which may include replacement, collection or refund.
24. Incorrect Product Ordered by the Customer
If the correct product was supplied based on the product selected or materially inaccurate vehicle information supplied by you, the return may be treated as a change-of-mind or customer-ordering-error return rather than a defective-product return.
Applicable return costs may then be payable by you, subject to statutory rights and our Returns and Refund Policy.
25. Refunds
Approved refunds will generally be made using the original payment method unless another lawful arrangement is agreed.
Processing times may depend on:
- The applicable statutory requirement;
- The payment method;
- Banking processing periods; and
- Whether returned goods reasonably need to be inspected.
Where legislation specifies a refund deadline, that deadline will apply.
We will not impose deductions or fees that are prohibited by applicable consumer law.
26. Promotions and Discount Codes
Promotional offers may be subject to additional terms displayed with the relevant promotion.
Unless stated otherwise:
- Promotions apply during the stated promotional period;
- Discount codes may be limited to one per transaction;
- A promotion may apply only to selected products;
- A promotion may be subject to available stock; and
- Discount codes may not be redeemable for cash.
Any promotional terms will be applied subject to the CPA and other applicable law.
27. Website Errors and Availability
We take reasonable steps to keep the Website operational and accurate.
However, uninterrupted access cannot be guaranteed.
The Website may occasionally be unavailable because of:
- Maintenance;
- Hosting failures;
- Network interruptions;
- Cybersecurity incidents;
- Software faults; or
- Circumstances outside our reasonable control.
We may modify, maintain or update the Website where reasonably necessary.

Unless otherwise stated, the Website and its original content, including:

Third-party vehicle, manufacturer and product names, trademarks and logos remain the property of their respective owners.
Reference to a vehicle manufacturer or trademark is generally used to identify compatibility and does not necessarily indicate affiliation, sponsorship or endorsement.
You may use the Website for personal shopping and other lawful purposes but may not reproduce or commercially exploit protected content without permission.
29. Content You Submit
If you send us vehicle photographs, part photographs, reviews, messages or other material, you confirm that:
- You are entitled to provide the material;
- The material is not unlawful;
- It does not knowingly infringe third-party rights; and
- It does not contain malicious software.
You permit us to use submitted material to the extent reasonably necessary to:
- Respond to your enquiry;
- Identify a product;
- Process an order;
- Provide customer support;
- Investigate a return or warranty claim; or
- Operate our services.
We will process personal information contained in submitted material in accordance with our Privacy Policy.
We will not use customer photographs for unrelated public advertising without an appropriate lawful basis or permission where required.

Any limitation of liability in these Terms must be interpreted subject to the CPA and other applicable South African law.
33. Indemnity
To the extent permitted by law, you agree to be responsible for losses reasonably arising from your:
- Fraudulent use of the Website;
- Intentional violation of these Terms;
- Unlawful activity;
- Infringement of third-party rights; or
- Deliberate provision of materially false information.
This clause does not require a consumer to indemnify us against our own prohibited conduct, negligence or liability that cannot lawfully be excluded.
34. Events Beyond Our Reasonable Control
We will not be regarded as breaching these Terms solely because performance is prevented or delayed by an event genuinely outside our reasonable control, including:
- Natural disasters;
- Severe weather;
- Civil unrest;
- War;
- Government restrictions;
- Widespread network failures;
- Strikes;
- Major transport disruptions;
- Supplier disruptions;
- Epidemics or public emergencies; or
- Other comparable events.
We will take reasonable steps to minimise the impact of such events.
Your statutory rights remain unaffected.

Nothing in these Terms prevents a consumer from approaching a competent consumer-protection authority, ombud, tribunal or court where entitled to do so.

Any dispute will be dealt with by a court, tribunal, ombud or other forum having lawful jurisdiction.
Nothing in these Terms requires a consumer to waive a statutory right to approach a competent consumer-protection body or court.
